PIVOT Terms of Service

Effective date: 28 August 2026. Version 1.0.

These Terms of Service (the "Terms") are a binding agreement between you and Ivan Gajinov, an individual established in the Republic of Serbia ("PIVOT", "we", "us", "our"). They govern your access to and use of the PIVOT mobile application, our servers and everything we make available through them (together, the "Service").

By creating an account or using the Service you agree to these Terms and to our Privacy Policy, which explains how we handle your personal data. If you do not agree, do not use the Service.

Section 17 contains an arbitration agreement and a class action waiver that affect how disputes are resolved. Please read it. Consumers in the European Union, the United Kingdom and certain other places keep the protections described in sections 16 and 17.

1. Who can use PIVOT

You may use the Service only if:

By using the Service you confirm that all of the above are true. We may ask for evidence of your age and may suspend or delete an account where we have reason to believe its holder is under 18.

2. What PIVOT is

PIVOT is a free-to-play prediction companion for professional basketball. It shows schedules, live scores and statistics for the competitions we cover, lets you predict outcomes ("picks"), shows how the community is split on each game, keeps your record, ranks users on a leaderboard and lets you compete with people you invite in private leagues.

PIVOT is not gambling. There are no stakes, no entry fees, no wagers, no odds-based payouts and no prizes. Nothing in the Service has monetary value. Picks are made for entertainment and bragging rights only. You do not need to buy anything to use any part of the Service, and you cannot buy anything inside it.

The competitions we cover may change over time. We may add or remove competitions, markets, statistics or features at any time.

PIVOT is an independent product. We are not affiliated with, endorsed by or sponsored by any league, competition, club, player, players' association, broadcaster or data provider. See section 9 for how their names and marks appear in the Service.

3. Your account

Registration. To use the Service you must create an account with an email address and password, or through Google or Apple sign-in, and choose a nickname. You must give us accurate information and keep it up to date.

One account per person. You may hold only one account. You may not create an account for anyone else, share your account, or transfer it to anyone.

Security. You are responsible for everything that happens under your account. Keep your password confidential, use a password you do not use elsewhere, and tell us promptly at the support address in section 21 if you believe your account has been accessed without your permission.

Nicknames. Nicknames are public and must be 3 to 20 characters using letters, digits and underscores. You may not choose a nickname that impersonates another person or organisation, infringes anyone's rights, is offensive, or misleads other users. We may change or reclaim any nickname that breaks these rules, that is inactive, or that we need for the operation of the Service.

Sign-in providers. If you sign in through Google or Apple, your use of those services is governed by their terms. We are not responsible for them.

Ending your account. You can delete your account at any time from Settings in the app. Deletion is immediate and permanent; see section 12.

4. Picks, scoring and leaderboards

Making picks. A pick is a prediction on one side of a market we offer for a game, such as the winner or whether a player will exceed a line. You can make, change or withdraw a pick at any time before the game's scheduled start. From that moment the pick is locked and cannot be changed or withdrawn.

Settlement. After a game ends we settle its markets automatically using official results and statistics as delivered to us by our data providers. A pick is scored as a hit, a miss or void. A pick is void, and counts as neither a hit nor a miss, where the game is cancelled or abandoned, a player did not play, or we withdraw the market for any reason described below.

Withdrawn markets. We may remove a market before or during a game, for example when a player is reported injured or a line was set in error. Every pick on a removed market is deleted as if it had never been made. We may also void a market at any time before settlement where the line or the market itself was wrong.

Corrections. Official statistics are sometimes corrected after a game. We may re-settle markets and recalculate records and rankings to reflect corrected data, and we may correct any error in settlement, statistics or rankings at any time.

Finality. Our determination of the result of a market, and of every hit, miss and void, is final, except where we correct a manifest error under this section.

Leaderboards and records. The global leaderboard ranks users by the number of hits, with the number of picks made used only to break ties. Rankings, records and statistics are calculated automatically from settled picks and may be recalculated at any time. We give no guarantee that rankings will be maintained, displayed or kept in any particular form.

Data accuracy. Schedules, live scores, statistics and lines come from third parties and may be delayed, incomplete or inaccurate. We do our best to present them faithfully but do not guarantee them and are not responsible for any decision you make in reliance on them.

5. Private leagues

Creating and joining. Any user may create a private league, choose what it competes on and share invite codes. Anyone who joins with a valid code becomes a member. Leagues are limited in size.

League names. League names are visible to every member of that league and must comply with section 7. We may rename or remove any league whose name breaks these Terms.

Invite codes. Invite codes are personal and short-lived. Do not post them publicly. Every member can generate their own codes; the owner can see and revoke any code. A code stops working when it expires, reaches its use limit or is revoked.

Owners. The owner of a league may remove members and revoke invite codes. Members may leave at any time. The owner may not leave while other members remain.

League picks. Picks made in a league count for that league only. They are private: no other user, including other members of the same league, can see them. League standings are visible to all members.

Ownership transfer and dissolution. If the owner deletes their account, ownership passes automatically to the longest-standing remaining member. A league with no remaining members is dissolved and its data deleted. We may also dissolve any league that breaks these Terms or that we can no longer support.

6. What other users can see

PIVOT is a community game. Your nickname, account identifier, join date, prediction record and statistics, settled arena picks and leaderboard position are public and can be viewed by anyone using the Service. Your email address, name, age, country, pending arena picks and league picks are never shown to other users. Details are in our Privacy Policy. Choose your nickname and league names accordingly.

7. Acceptable use

You agree not to:

We may investigate any suspected breach and take any action we consider appropriate, including removing content, resetting picks, recalculating records, suspending or terminating accounts, and reporting to law enforcement.

8. Your content

"Your content" means anything you submit to the Service, including your nickname, league names, any profile picture and your picks.

Responsibility. You are solely responsible for your content and confirm that you have every right needed to submit it and that it complies with section 7.

Licence. You keep whatever rights you have in your content. You grant us a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, display, adapt and distribute your content, and to compute statistics and aggregates from it, for the purpose of operating, improving and promoting the Service. For picks and statistics this licence continues after you delete your account only in anonymous, aggregated form, as described in our Privacy Policy.

Moderation. We may review, edit, hide or remove any content at any time and for any reason, including content we believe breaks these Terms, without notice and without liability to you. We are not obliged to monitor content.

Reporting. If you believe any content on the Service breaks these Terms or infringes your rights, email the support address in section 21 with a description of the content, where it appears and why it should be removed. We will review every report.

9. Intellectual property

The Service. The app, our servers, the PIVOT name and logo, and all software, design, text, graphics and data compiled by us are owned by us or our licensors and are protected by copyright, trademark and other laws. Subject to these Terms we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your personal, non-commercial entertainment. All rights not expressly granted are reserved.

Sports data. Schedules, scores, statistics and lines are licensed to us by third-party data providers. You may view them in the app for personal use only. You may not extract, redistribute or commercially exploit them.

Third-party names and marks. The names, logos, crests, colours and other marks of leagues, competitions, clubs and players that appear in the Service belong to their respective owners. They are used solely to identify the games, teams and players you can predict, in a purely descriptive way. Their appearance does not imply any affiliation, sponsorship or endorsement, and no licence to them is granted to you. If you are a rights holder and believe any material in the Service infringes your rights, contact the support address in section 21 and we will respond promptly.

Feedback. If you send us ideas or suggestions about the Service, we may use them without any obligation to you.

10. Third-party services and app stores

The Service relies on third-party services, including authentication, hosting and sports data providers, Google and Apple sign-in, and the Apple App Store and Google Play. We do not control those services and are not responsible for their availability, content or handling of your data. Your use of them is governed by their own terms.

Where you obtained the app from the Apple App Store, section 19 also applies. Where you obtained it from Google Play, your use is also subject to the Google Play Terms of Service.

11. Changes to the Service and availability

The Service is provided as it is at any given moment. We may change, suspend or discontinue any part of it, including any competition, market, feature, ranking period or league type, at any time, with or without notice. We may also impose limits on features or restrict access to parts of the Service.

We do not guarantee that the Service will be available at any time or without interruption. Live data in particular depends on third parties and may be delayed or unavailable. We are not liable for any downtime, data delay or loss of picks, records or rankings resulting from any unavailability, change or discontinuation of the Service.

Some features may be released as beta or early access. They may not work as intended and may be withdrawn at any time.

12. Suspension and termination

By you. You may stop using the Service at any time and may delete your account from Settings. Deletion permanently removes your login, profile, picks, statistics, league memberships and league picks. It cannot be undone. Ownership of any league you own passes to its longest-standing remaining member, or the league is dissolved if none remains.

By us. We may suspend or terminate your access to all or part of the Service, delete your account, remove your content or reset your picks and records, immediately and without notice, if we reasonably believe that you have broken these Terms or the law, that your account is being used fraudulently or by someone under 18, that your use creates risk or legal exposure for us or other users, or that we are required to do so by law. We may also terminate the Service entirely on reasonable notice.

Effect. On termination your licence to use the app ends and you must stop using it. Sections that by their nature should survive, including sections 8 (licence), 9, 13 to 18 and 20, survive termination.

13. Disclaimers

To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be accurate, reliable, uninterrupted, secure or error-free; that data, scores, statistics or lines will be correct or timely; that defects will be corrected; or that the Service will meet your requirements.

Nothing in the Service is advice of any kind. Picks, community splits, lines and statistics are for entertainment and must not be relied on for any wagering, financial or other decision.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. Consumers have legal rights that cannot be excluded, and nothing in these Terms affects them.

14. Limitation of liability

To the fullest extent permitted by applicable law:

These limitations apply to the extent permitted by law. They do not exclude or limit liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any other liability that cannot be excluded or limited under the law that applies to you. If you are a consumer in the European Union, the United Kingdom, Serbia or another jurisdiction with mandatory consumer protection law, you keep every right that law gives you and nothing in this section reduces our liability below what that law allows.

15. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold harmless PIVOT and its employees, contractors and licensors from any claim, demand, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of your content, your use of the Service, or your breach of these Terms or of any law or third-party right. This section does not apply to consumers in jurisdictions where such an obligation cannot be imposed on consumers.

16. Governing law

These Terms, and any dispute or claim arising out of or in connection with them or the Service, are governed by the laws of the Republic of Serbia, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country where you habitually reside. Consumers in the European Union, the EEA and the United Kingdom in particular retain the benefit of the mandatory consumer protection rules of their home country and the right to bring proceedings in the courts of their home country.

17. Dispute resolution, arbitration and class action waiver

Please read this section carefully. It limits the ways you can seek relief from us.

17.1 Talk to us first

Before starting any formal proceeding, you agree to contact us at the support address in section 21 with a written description of the dispute and what you want us to do about it, and to give us 30 days to try to resolve it informally. We will do the same before starting a proceeding against you.

17.2 Binding individual arbitration

If we cannot resolve a dispute informally within 30 days, you and we agree that any dispute, claim or controversy arising out of or relating to these Terms or the Service, including its formation, interpretation, breach, termination or validity, and including any claim under a statute, will be resolved by final and binding arbitration before a single arbitrator, and not in court.

The arbitration will be administered by the Permanent Arbitration at the Chamber of Commerce and Industry of Serbia under its rules in force when the arbitration begins. The seat of arbitration will be Belgrade, Serbia. The language of the arbitration will be English. The arbitrator may award any relief that a court could award to the individual party seeking it, and the award may be entered in any court with jurisdiction. Either party may attend hearings by video conference, and where the amount in dispute is below EUR 10,000 the arbitration will be conducted on documents alone unless the arbitrator decides otherwise. We will pay all administrative and arbitrator fees above the amount of any court filing fee you would otherwise have paid, unless the arbitrator finds your claim frivolous.

17.3 Class action and jury waiver

You and we agree that each of us may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of class or representative proceeding. To the extent permitted by law, you and we each waive any right to a jury trial. If the class action waiver in this paragraph is found unenforceable as to a particular claim, then that claim, and only that claim, will be severed from arbitration and heard in court under section 17.6, while all remaining claims stay in arbitration.

17.4 Exceptions

Either party may bring an individual claim in a small claims court with jurisdiction, provided the claim stays in that court and is not brought on a class or representative basis. Either party may seek an injunction or other equitable relief in any court with jurisdiction to protect its intellectual property rights or to prevent unauthorised access to or abuse of the Service.

17.5 Opt-out

You may opt out of the arbitration agreement in section 17.2 and the class action waiver in section 17.3 by emailing the support address in section 21 within 30 days of first accepting these Terms, stating your account email and that you wish to opt out of arbitration. Opting out does not affect any other part of these Terms.

17.6 Consumers in the EU, EEA, UK and elsewhere

If you are a consumer in the European Union, the EEA, the United Kingdom, Switzerland or any other country whose law does not permit a pre-dispute agreement to arbitrate with consumers, sections 17.2 and 17.3 do not bind you. You may instead bring any claim in the courts of the country where you habitually reside, and we may bring claims against you only in those courts. You remain free to agree to arbitration with us after a dispute has arisen. Nothing in this section removes your right to complain to a consumer protection or data protection authority, or to use any alternative dispute resolution body available under your local law.

17.7 Courts

Subject to sections 17.4 and 17.6, and for any dispute that is not subject to arbitration, you and we agree to the exclusive jurisdiction of the competent courts in Belgrade, Republic of Serbia.

17.8 Time limit

To the extent permitted by law, any claim arising out of or relating to these Terms or the Service must be brought within one year after the claim arose, or it is permanently barred.

18. Changes to these Terms

We may change these Terms from time to time. The effective date and version number at the top show when they last changed. For material changes we will give you at least 30 days' notice inside the app, by email, or both, before the new Terms take effect, unless the change is required by law or concerns a new feature, in which case it may take effect immediately. If you do not agree to the new Terms you must stop using the Service and may delete your account before they take effect. Continuing to use the Service after a change takes effect means you accept it. The current Terms are always available in the app under Settings, App info, Terms of service.

19. Apple App Store terms

If you obtained the app from the Apple App Store, the following also applies. These Terms are between you and us only, not with Apple Inc. ("Apple"), and Apple is not responsible for the app or its content. The licence in section 9 is limited to use of the app on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing. Apple has no obligation to provide any maintenance or support for the app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund any purchase price paid for the app (which is nil); to the maximum extent permitted by law Apple has no other warranty obligation. We, not Apple, are responsible for addressing any claim by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and consumer protection or similar claims. In the event of any third-party claim that the app infringes that party's intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of the claim. You represent that you are not located in a country subject to a United States government embargo or designated as a "terrorist supporting" country, and that you are not on any United States government list of prohibited or restricted parties. You must comply with applicable third-party terms when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

20. General

Entire agreement. These Terms, together with the Privacy Policy and any rules we publish for a specific promotion or feature, are the entire agreement between you and us about the Service and replace any earlier agreement.

Severability. If any provision of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted and the rest of the Terms will remain in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign or transfer these Terms or your account. We may assign these Terms to an affiliate or to a successor in connection with a merger, acquisition or sale of assets, and will notify you if we do.

Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including failures of third-party data providers, hosting providers, networks or app stores.

Language. These Terms are written in English. Any translation is provided for convenience only; the English version prevails.

Export and sanctions. You must comply with all applicable export control and sanctions laws in connection with your use of the Service.

Notices. We may give you notice inside the app or by email to the address on your account. You may give us notice at the addresses in section 21.
